  • Mental Capacity – The Assisted Decision-Making (Capacity) Act 2015

    The Assisted Decision-Making (Capacity) Act 2015 reforms Ireland’s former capacity legislation, which had been in place since the 19th century.

    The Act establishes a modern statutory framework to support decision-making by adults who have difficulty in making decisions without help; where previously in some circumstances it was necessary for persons to be made Wards of Court.  The Wards of Court system is being phased out and all matters are now under the supervision of the Decision Support Service (the DSS).
