Injury Claims
The Plaintiff Julie Green claimed damages for injuries to her shoulder and lower back as result of slip and fall on rainwater inside the entrance of the door of the respondent’s shop in Ennis. Plaintiff claimed that there were no mats in position and no warning that the floor was wet. A lot of these Claims are dismissed but this one succeeded.
Mr Justice Barr decided that the plaintiff’s accident was due to the negligence of defendant Dunnes Stores in failing to place a mat just inside the entrance door. Because the Plaintiff suffers ongoing pain in the lower back and was obliged to take painkillers and anti-inflammatory medication on a regular basis and was likely to suffer pain in the long term he awarded Damages of €75,310.
