    A recent ruling by the European Court of Justice has called into question whether imposing compulsory redundancy will be ‘objectively justifiable’ for some employers in the UK and NI.
    In the German case of Fuchs v Land Hessen, the ECJ ruled that it was a ‘legitimate aim’ for an employer to seek to prevent legal disputes with older employees over their continued fitness for service by imposing compulsory retirement. However, ‘People Management’ has warned that the legal reasoning on this point in the judgment is thin. The view at present is that it remains ‘risky’ to apply the approach of the ‘ECJ’ for private sector employers. Case law will help to clarify the position as it develops.
